“An Alberta ‘First Nation’ {aboriginal community} that’s suing the province and federal government…has filed a request — known as an application for advance costs — for the two levels of government to front all of its legal costs.

We’re having to sacrifice housing, education, health — very basic necessities and very basic treaty rights in order to continue to fight for our treaty rights.”

{They’re suing over loss of traditional hunting and gathering {which most don’t want to do any more} due to development in their surrendered-by-treaty former territory. The treaty that their ancestors signed clearly states that development supercedes hunting and gathering rights…

And Her Majesty the Queen HEREBY AGREES with the said Indians that they shall have right to pursue their usual vocations of hunting, trapping and fishing throughout the tract surrendered as heretofore described…saving and excepting such tracts as may be required or taken up from time to time for settlement, mining, lumbering, trading or other purposes.”

“In 2008, the Beaver Lake Cree ‘Nation’ {a ‘nation’ of 1,196 people} filed a lawsuit against Alberta and Ottawa alleging that so much development had been permitted on their land that it had rendered their ‘right’ to traditional activities meaningless… It alleges it has never been properly consulted on the developments or compensated for the damage they have caused.
{The only compensation required by Treaty is for RESERVE LANDS that are developed – NOT ‘traditional territories’ — and NO ‘consultation’ is required by Treaty on surrendered land…}

“Karey Brooks, lawyer for the Beaver Lake Cree, who live about 100 kilometres north of Edmonton near Lac La Biche, acknowledged the case is complex and involves records numbering in the hundreds of thousands of pages. Still, she said co-operation has been grudging…{the government} arguing the case is so large as to be almost unmanageable.

“The ‘First Nation’ calculates it has already spent about $2.8 million on the lawsuit, about half paid for through outside donations and half by the Band. It estimates that concluding the action will cost another $2.2 million.

“That’s tough on the Band’s finances, said ‘treaty co-ordinator’ Crystal Lameman.

We’re having to sacrifice housing, education, health — very basic necessities and very basic treaty rights {neither ‘housing’ nor ‘health’ is mentioned in ‘Treaty 8’. These are gifts from the Canadian taxpayers, for which they are NEVER thanked!} in order to continue to fight for our ‘treaty rights’.”
