‘UPDATE: Another Treaty Adjustment (So You Think You Own Land?)’

Ownership of the northern section of Sauble Beach {Now known as ‘Saugeen Beach’/‘Chi-Gmiinh’} was transferred to the Saugeen ‘First Nation after a legal ruling, meaning visitors access it as guests under new rules and a name change.

The Court of Appeal’s landmark decision is the first time that a court has found that an Aboriginal interest in land overrides a fee simple title held by private landowners.{Which the federal government promised would never happen. So, here we go…}

The Sauble Beach land claim was a decades-long legal battle where the Saugeen ‘First Nation’ {a ‘nation’ of 2,016 people} successfully ‘regained’ ownership of a significant portion (about 2.2-2.4 km) of the shoreline. In August 2025, the Supreme Court of Canada dismissed the final appeal from the Town of South Bruce Peninsula, upholding lower court rulings that ‘returned’ the land, now known as ‘Chi-Gmiinh’ (Sauble Beach), to the ‘First Nation’ {Tribe/Band}, concluding a 30-year fight.”

The Court of Appeal’s landmark decision is the first time that a court has found that an Aboriginal interest in land overrides a fee simple title held by private landowners.

The Judge rejected the individual landowners’ arguments that they should be given life estates entitling them to own the disputed beach until their deaths, holding that this would “not advance reconciliation in the circumstances of this case.”

The Chippewas of Saugeen ‘First Nation’ object to the issuance of any life interest in the Disputed Lots to the defendants, Alberta Lemon, the Estate of Barbara Twining and David Dobson (the “Landowners”). Canada supports this position {?!?}.” {So, if you B.C. landowners expect any help from either the federal government or the courts…}
