We have a suggestion: Let the government fund everything that the ‘Mohawk Mothers’ are asking for and, if nothing should be found, they be assessed the full cost. The same should be applied to all ‘grave searches’. That’s the only thing that will finally end this nonsense…

“The conditions were part of a deal reached in November with the ‘Mohawk Mothers’ — a group of ‘Kanien’kehá:ka’ {Iroquois} women — that outlined the search for possible unmarked graves at the site.
“The agreement came after the Mohawk Mothers launched a civil suit in March 2023, seeking to halt the development. The group argued there may be unmarked ‘Indigenous’ graves that risked being excavated at the site, as well as archeological remains from a pre-colonial Iroquoian settlement…”

“Two independent archeologists are at the centre of a legal battle that pits McGill University and the Quebec government against a Mohawk group in the Court of Appeal of Quebec…
“All sides agreed to hire the archeologists last year as part of the search for ‘possible’ clandestine burials at the site of the former Royal Victoria Hospital and the adjacent Allan Memorial psychiatric institute.
“In November, the Mohawk Mothers, a group from Kahnawake, convinced a Superior Court judge that the archeologists should continue to be part of the search.
“McGill and the Société québécoise des infrastructures (SQI) are appealing that decision, saying the archeologists’ work is completed.
“The ‘Mohawk Mothers’ say they’re concerned about how the search is being conducted, accusing McGill and the SQI of “unilaterally taking control of the investigation”.

“McGill and the SQI maintain they are committed to uncovering the truth. They say they adhere to a court-approved process for conducting their investigations. And they note searches carried out last year yielded no evidence of burials.

“In 2022, the ‘Indigenous’ {sic, Canadian Aboriginals are ‘Indigenous’ to Siberia and Mongolia} group was granted an injunction that suspended excavation at the site of McGill’s expansion. It was lifted in April 2023 after all sides signed an agreement that is now at the centre of legal wrangling. A panel of three archeologists was hired to map the site and recommend archeological techniques.
“McGill and the SQI insist the panel’s mandate ended in July 2023 after the archeologists laid out how the search for bodies should be conducted and suggested specialized companies to do the work…

“Doug Mitchell, a lawyer representing McGill, told the court Tuesday that the university has “respected the letter and the spirit of the law”.

“McGill and the SQI have said the archeologists’ mandate was limited and they are only to be called back into the process in the event of “an unexpected discovery” on the site. McGill said in a submission to the court that despite “extensive searches”, there have so far “been no discoveries indicative of potential unmarked burials” on the site.
“The “vast majority” of anomalies found by ground-penetrating radar and search dogs “have been investigated and the possibility of unmarked graves ruled out”, the university said.
“The SQI says it’s making every effort to uncover whether bodies were buried on the site. “The searches have been transparent” and have used “the highest standards of archeology”, Vicky Berthiaume, a lawyer for the SQI, argued in court.
“The organization said in a court filing that the two archeologists want to replace “the interpretation of experts and archeological geophysics with their own interpretation, even though their lack of scientific competence in the field is blatant”.
“In his judgment, Judge Moore cited a McGill estimate that “every month of delay in the redevelopment will increase costs by $2 million and cause an exponential impact on the cost of the overall project”. However, Moore wrote, “the delay and costs of the overall project cannot justify the SQI’s and McGill’s unilateral reduction of their obligations under the settlement agreement, especially when doing so will cause irreparable harm” to the Mohawk Mothers {What “irreparable harm”???}.

“The ‘Kanien’keha:ka Kahnistensera’, known as the ‘Mohawk Mothers’, were at the Court of Appeal of Quebec on Tuesday, continuing their legal battle in the search for unmarked graves at a former Montreal hospital site.
“The court is set to decide if independent archeologists should oversee the search at the former Royal Victoria Hospital. The case involves McGill University and the Société québécoise des infrastructures (SQI) – who are appealing a November Superior Court decision. They claim the archeologists’ work is completed.

“In November, Superior Court Justice Gregory Moore ruled in favour of the Mohawk Mothers and the archeologists, telling McGill and the SQI they must be guided by the ongoing recommendations of the panel. McGill and the SQI are appealing. It’s now up to the Court of Appeal to decide.

“Kwetiio, a member of the group, noted in court that a previous {Racist} ruling found that the search was to be “‘Indigenous’-led” {Why?}. That hasn’t happened, she said, because McGill and the SQI have repeatedly breached the agreement.
“Kwetiio said independent oversight is needed because the two institutions are standing in the way of a thorough search — for example, by not properly sifting earth that is excavated.

“During the 1950s and 60s, the Allen Memorial Institute at the Royal Victoria Hospital performed mind control experiments. The Mohawk Mothers say that there ‘could be’ survivors of those treatments buried at the site, both ‘Indigenous’ {sic} and non-‘Indigenous’.
“Last June, cadaver dogs identified ‘possible evidence’ of human remains on the site, and the Mohawk Mothers claim there are more findings.
“The findings that have happened in November and in May and the tests that have gone on, we’ve had more findings. And there was even a probing technique done”,
continued Kwetiio.
“It showed that there are human evidence in the ground {No, it didn’t}. And that’s something that was important to bring up today.”
“All sides had previously agreed to hire archeologists {And they did…}.
“A brief supporting them…was submitted by the federally-appointed ‘independent’ {Aboriginal activist} special interlocutor for missing children and unmarked graves and burial sites associated with Indian residential schools.

“McGill and the SQI have maintained that they are committed to uncovering the truth. And that they adhere to a court-approved process for conducting their investigations. They’ve previously noted searches carried out in 2023 yielded no evidence of burials {!}.
“We have to change the way that those children or those people got in the ground {?}. And we can’t continue that same cycle that now that we’re new generations, we have the same system. Something has to change, and that’s what we’re here for”,

“You want to take remains that need to be sifted, need to be investigated and you just want to pick them up and throw them in a truck and move them somewhere else”,

“Well, what happens when you find something in that pile somewhere else? You will have already started your construction down here, jeopardizing the ‘evidence’ that lays there.”
“The Société Québécoise des Infrastructures (SQI), which is overseeing the campus expansion project, said the piles are being moved at the request of archaeologists, who want to sift through the material at a safer, quieter location.

“The soil is moved one pile at a time, to avoid mixing. One archeologist supervises the loading of the truck, while another supervises the unloading. Each pile is clearly identified and a sifting priority procedure is developed”,
spokeswoman Anne-Marie Gagnon wrote in an email Monday, adding that the piles are covered with weatherproof material to protect them from the elements {!}.
“The SQI and McGill University say they’re honouring an agreement they entered into with the ‘Mothers’ {Well, now you see what you get in return}.
“Last month, the ‘Mothers’ failed in their attempt to obtain an emergency court order to stop excavation on part of the site, where a psychiatric institute used to operate. The government of Canada is named in a 2019 class-action lawsuit application that alleges the state funded abusive psychological experiments — part of the infamous ‘MK-Ultra’ program — on vulnerable patients at the Allan Memorial Institute in the 1950s and 1960s.

“‘Cultural monitors’ appointed by the ‘Mohawk Mothers’ have been given access to the site for all phases of work”,
McGill spokesman Michel Proulx wrote in an email Monday.
“To date, no evidence has been found to substantiate the presence of unmarked graves.”
“‘Kwetiio’ says McGill and Quebec’s infrastructure agency are not acting in good faith. She says McGill and the province committed to thoroughly searching, within a 10-metre radius, areas where sniffer dogs signalled that human remains might be found — but that isn’t happening.
“We’re being stopped from doing a proper investigation”,

“‘Kwetiio’ said her group also wants to search a building that is located within the 10-metre radius, because of ‘the possibility’ that remains will be found in the basement.
“An observer affiliated with the ‘Mothers’ recently found what appeared to be the leather sole of a child’s shoe, ‘Kwetiio’ said. When the shoe was handed over, the ‘Mothers’ were told — to their surprise — that bones had also been discovered, she said.
“We’re not being told when things are found”, {?}
she said, adding that she has received no details about where the bones were located or whether they are human or animal.
“McGill says that according to a bio-archeologist who has searched the site, the remains found were animal bones.
“The archeological firm also confirms it does not consider that any of the articles uncovered during the excavation constitute significant discoveries, or that they constitute evidence of human remains or graves” {!},
Proulx said.
“Proulx said archaeological excavations have been conducted in the area where dogs identified the potential for human remains, as well as in nine other areas where ground-penetrating radar suggested the possible presence of unmarked graves. No further evidence of remains or graves were found, he said.
“The ‘Mothers’ legal proceedings against McGill and the province began in March 2022, when they filed a civil suit to stop construction. Last October, they obtained an injunction ordering a pause on excavation work, with a judge ruling the renovations would cause irreparable harm {?}. After several mediation sessions, the ‘Mothers’ and McGill reached a deal on April 6. ‘Cultural monitors’ are also permitted on site to observe.
“The agreement stipulates that if no graves are immediately found, excavation work can begin on a rolling basis and in a sensitive manner in case there is an unexpected discovery.”
