‘Squamish Fraud’

“A former Squamish ‘Nation’ {a ‘nation’ of 4,300 people} councillor, Krisandra Jacobs, went on trial last month in a BC provincial court, charged with defrauding the Band government of close to $1 million between April 1, 2011 and May 2, 2014. 

“Walter Schneider, the former COO of Squamish ‘Nation’ and a member who lived off-reserve his whole life, was hired in 2013, whereby he began a review of the ‘nation’s {Aboriginal community’s} accounts and subsequently realized an unusual number of cheques were being issued through the Band manager’s emergency fund. 

“…I started to see these other payments in there that no one mentioned, to Krisandra Jacobs and to Glen Newman. And that obviously raised a significant flag for me”,
he testified.

“Schneider brought his concerns to councillors Carla George, Deborah Baker and Julie Baker, who supported him in bringing those issues to the full Squamish ‘Nation’ council. However, the reaction of the full council was “very divided”, said Schneider. Council eventually conceded to an independent investigation conducted by a third-party lawyer, Nazeer Mitha.

“Over these three years, 422 cheques were made out to Jacobs of a value of nearly $1 million. Prosecutor Shelley Hulko added that a significant amount of these cheque requisitions came in after normal office hours. She credits Schneider for the discovery. “It was his investigation that led ultimately to the police investigation”, said Hulko.

“Even more damning, financial records point towards Jacobs attending casinos shortly after cheques were deposited into the account of either her or her husband.

“Squamish ‘Nation’ employee Donalene Rapada testified that she had raised concerns about Jacobs’ cheque requests with her supervisor, adding “she was concerned that those requests weren’t following the proper process and back-up documentation wasn’t being provided“.

“Under cross-examination by defence lawyer John Turner, Rapada agreed that Jacobs had indicated one reason she didn’t want to provide documents for the cheque requests was concern for the confidentiality of those Band members seeking help through the emergency fund.

“Following the initial investigation, both Jacobs and Band manager Glen Newman were fired from their jobs and were removed from their elected positions on council.”

“‘Loblaws Inc.’ is taking the provincial government to court over a $2.6-million motor fuel tax and interest bill after the company voluntarily disclosed the discovery of a years-long fraud scheme by third-party employees at a gas station on Squamish ‘Nation’ land in North Vancouver.

“Loblaws filed a petition in B.C. Supreme Court on July 4, seeking to vacate motor fuel tax and carbon tax assessments for the period between 2005 and 2008, and, failing that, an order waiving more than $1 million in accrued interest.

“According to the petition, the company owns the gas station at 333 Seymour Boulevard in North Vancouver, which it leases from a company owned by the Squamish ‘Nation’. Along with the ‘Real Canadian Superstore’, the gas station sits on reserve land, which, under the ‘Indian Act’, allows “Status Indians” to buy fuel exempt from the ‘Motor Fuel Tax Act’ (MFTA) and the ‘Carbon Tax Act’

“The gas station was operated by the Squamish ‘First Nation’ at the time and “there were no employees of the Petitioner {Loblaws} who were directly involved in the day-to-day operations of the Gas Bar”, the petition states.

“Employees were required to “take various steps to verify the eligibility of Status Indian customers for the Tax Exemption”, such as recording sales dates, customer names and Band membership information. In 2013, the company uncovered a fraud scheme by certain employees who were fraudulently overstating exempt gas sales by inflating volumes on exemption logs, or “recording entries for non-existent tax exempt purchases”. The employees allegedly pocketed a portion of the funds, money that would have otherwise gone to provincial government coffers. The remainder went to the Squamish ‘Nation’ as a levy paid by status customers on tax-exempt fuel sales.

Loblaws claims it immediately began an internal investigation and contacted the RCMP to report the fraud, while also initiating a voluntary disclosure for potential unremitted taxes with British Columbia’s Ministry of Finance. However, the Finance Ministry’s audit covered years that preceded statutory limitation periods and hit the company with a motor fuel tax bill of $1,641,079 with $1,030,527 in interest, as well as a carbon tax bill of $17,266 and $6,683 in interest.

“The company unsuccessfully appealed the assessments, which were confirmed in March 2019. Despite the limitation period set out in the MFTA, the legislation allows the government to assess for years beyond it
when there has been a contravention of the MFTA involving wilful default or fraud”.

“The company claims the assessments are “not supported on the facts and/or applicable law”. The petition’s factual basis has not been tested in court and the provincial government had not filed a response by press time.”

“The Sacred MOSQUITO CREEK MARINA has many, many, many Boathouses with boats inside them of course (ie: Chris Crafts, Monk Cruisers, Grand Banks,) and inside these Boathouses they allow LIVEABOARDS. Now these Liveaboards wash dishes, do laundry, take showers and SHIT !! YES Liveaboards have many, many many SHITS and where does all this SHITTY water go??????? It drains right into the MOSQUITO CREEK MARINA Water Basin and the Sacred Squamish ‘First Nation’ Indian Band depends on the TIDE to take all this SHIT out under the Lions Gate Bridge into English Bay and beyond.
